General terms

§ 1 General

The (general) Austrian hotel contractual conditions constitute the terms of contract under which Austrian hoteliers normally conclude contracts of accommodation with their guests. The Austrian hotel contractual conditions do not preclude special agreements.

§ 2 Contracting Party

  1. In the event of doubt the person making the reservation shall be deemed to be the
    contracting party of the hotelier including when same has made a reservation on behalf
    of other persons specified by name or has simultaneously made an additional booking on their behalf.

  2. The persons availing themselves of the accommodation shall be guests for the purposes of the contractual conditions.


§ 3 Conclusion of Contract, Deposit

  1. The contract of accommodation generally comes into being on acceptance by the hotelier of the written or verbal order placed by the guest.

  2. It may be agreed that the guest is to pay a deposit.

  3. The hotelier may also request advance payment of the total remuneration agreed.


§ 4 Commencement and End of Accommodation

  1. The guest shall be entitled to make use of the rooms hired from 2.00 pm on the date agreed.

  2. Where the guest fails to appear by 6.00 pm on the agreed day of arrival, the hotelier shall be entitled to withdraw from the contract unless a later time of arrival has been agreed.

  3. Where the guest has paid a deposit, the room(s) shall on the other hand be reserved at the latest until 12 noon of the following day.

  4. Where a room is used for the first time before 6.00 in the morning, the preceding night
    shall be counted as the first night of accommodation.

  5. The rooms hired shall be vacated by the guest by 12 noon on the day of departure.


§ 5 Withdrawal from Contract of Accommodation - Cancellation Charge

       Cancellation by hotelier

  1. Where the contract of accommodation provides for the payment of a deposit and said deposit is not paid by the contracting party in a timely manner, the hotelier may withdraw from the contract of accommodation without any further extension of time.

  2. Where the guest fails to appear by 6.00 pm of the agreed day of arrival, no obligation of accommodation shall exist unless a later time of arrival has been agreed.

  3. Where a deposit has been paid by the contracting party (cf. 3.3), the premises shall on the other hand be reserved at the latest until 12 noon of the day following the date agreed for his stay. In the case of advance payment for more than four days, the obligation of accommodation shall end at 6.00 pm of the fourth day, with the day of arrival being counted as the first day unless the guest specifies a later day of arrival.

  4. The contract of accommodation may be terminated by the hotelier by means of unilateral declaration at the latest up to 3 months before the day of arrival agreed by the contracting party, for reasons justified by the circumstances unless agreed otherwise.

       Cancellation by contracting party - Cancellation charge

  1. The contract of accommodation may be terminated by means of unilateral declaration by the contracting party at the latest up to 3 months before the day of arrival of the guest without the payment of any cancellation charge.

  2. Outside the period laid down in § 5.5. cancellation shall only be possible by means of unilateral declaration by the contracting party on payment of the following cancellation charges:
    - up to 1 month prior to the day of arrival 40% of the entire package price;
    - up to 1 week prior to the day of arrival 70% of the entire package price;
    - in the final week prior to the day of arrival 90% of the entire package price.

§ 6 Provision of Alternative Accommodation

The hotelier may provide the guest with appropriate alternative accommodation where the guest can be reasonably expected to accept same, in particular given that such divergence is insignificant in nature and justified by the circumstances.


§ 7 Rights of Guest

The guest shall be entitled to take up residence in the rooms hired from 2.00 pm of the agreed day.


§ 8 Obligations of Guest

The agreed remuneration shall be paid at the end of the contract of accommodation. Foreign currency shall be accepted as payment by the hotelier as he deems fit at the exchange rate applicable on that day. The hotelier shall not be obliged to accept cashless payment such as cheques, credit cards, tokens, vouchers etc.
All costs incurred on acceptance of such instruments, for example, for telegrams, enquiries etc. shall be for the guests account.


§ 12 Pets

1. Pets may only be brought into the accommodation establishment subject to prior consent and at all events on payment of a special fee. Pets may not be taken into lounges, function rooms and restaurant areas.

2. The guest shall be liable for any damage caused by pets he has brought with him, in accordance with the statutory provisions applicable to the owners of animals (§ 1320 Austrian Civil Code).


§ 16 Place of Performance and Legal Venue

  1. The place of performance shall be the place at which the accommodation establishment is located.

  2. For all disputes ensuing from the contract of accommodation the court locally competent and competent for the accommodation establishment as regards the subject matter shall be agreed, unless

  a) the guest has as a consumer a place of employment or abode within Austria;
            in such case the place indicated by the guest in his registration shall be agreed as
            the legal venue;

          b) the guest only has as a consumer a place of employment within Austria; in such
            case this shall be agreed as the legal venue.
